Terms & Conditions

These Terms and Conditions ("Agreement") govern your participation in the Obsidian Affiliates Program ("Program") operated by ObsidianAffiliates Ltd ("Company", "we", "us", or "our"). By registering for or participating in the Program, you ("Affiliate", "you", or "your") agree to be bound by this Agreement.

We reserve the right to modify these terms at any time. Continued participation in the Program following any changes constitutes acceptance of those changes.

2.1 Eligibility Requirements

To participate in the Program, you must:

• Be at least 18 years of age (or the legal age in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Own or control the website(s) or marketing channels you register
• Comply with all applicable laws and regulations in your jurisdiction
• Not be located in any restricted territory as communicated by us

2.2 Application Process

All applications are subject to review and approval at our sole discretion. We reserve the right to reject any application without providing a reason. Approval of your application does not guarantee continued participation in the Program.

3.1 Promotional Standards

As an Affiliate, you agree to:

• Promote our brands in a professional, ethical, and legal manner
• Only use marketing materials approved by us or created in accordance with our guidelines
• Clearly disclose your affiliate relationship where required by law
• Not make false, misleading, or exaggerated claims about our brands
• Not target minors or promote gambling to underage individuals
• Comply with all responsible gambling guidelines and regulations

3.2 Prohibited Activities

The following activities are strictly prohibited:

• Spam, unsolicited emails, or any form of unauthorized communication
• Cookie stuffing, click fraud, or any manipulation of tracking
• Bidding on brand terms or trademark keywords without permission
• Creating fake reviews or incentivized sign-ups
• Promoting in jurisdictions where online gambling is prohibited
• Using malware, adware, or deceptive practices to generate traffic
• Self-referrals or referring friends/family without genuine traffic
• Any activity that damages our brands' reputation

4.1 Commission Types

We offer the following commission structures, subject to individual agreement:

• Revenue Share: A percentage of net gaming revenue generated by referred players
• CPA (Cost Per Acquisition): A fixed payment for each qualified first-time depositor
• Hybrid: A combination of CPA and Revenue Share

Specific commission rates will be agreed upon during onboarding and may vary based on traffic quality, volume, and promotional methods.

4.2 Payment Terms

• Payments are processed monthly, typically within the first 10 business days
• Minimum payout thresholds apply and vary by payment method
• Available payment methods include bank transfer, cryptocurrency, and e-wallets
• You are responsible for any taxes applicable to your commission earnings
• We reserve the right to withhold payment pending verification of traffic quality

4.3 Chargebacks & Adjustments

Commissions may be adjusted or reversed in cases of:

• Fraudulent or suspicious player activity
• Player chargebacks or bonus abuse
• Violation of this Agreement
• Duplicate accounts or self-referrals

We provide real-time tracking and reporting through our affiliate dashboard. While we strive for accuracy, our tracking data shall be the sole basis for calculating commissions. Any discrepancies must be reported within 30 days of the relevant reporting period.

All trademarks, logos, and marketing materials remain our exclusive property or that of our brand partners. You are granted a limited, non-exclusive, revocable license to use approved materials solely for promoting the Program. This license terminates immediately upon termination of your affiliate account.

You agree to keep confidential all non-public information relating to the Program, including commission rates, conversion data, and business strategies. This obligation survives termination of this Agreement.

8.1 Termination by Either Party

Either party may terminate this Agreement at any time with written notice. Upon termination:

• All rights granted to you under this Agreement cease immediately
• You must remove all affiliate links and marketing materials
• Outstanding commissions will be paid subject to our standard verification procedures

8.2 Termination for Cause

We may terminate your account immediately without notice if you breach this Agreement, engage in fraudulent activity, or damage our reputation. In such cases, we reserve the right to withhold any pending commissions.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Program. Our total liability shall not exceed the commissions paid to you in the 12 months preceding any claim.

You agree to indemnify and hold harmless ObsidianAffiliates Ltd, its officers, directors, employees, and brand partners from any claims, damages, or expenses arising from your breach of this Agreement or your promotional activities.

This Agreement shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
